Why Kanye West & Kim Kardashian West May NOT Face Prosecution For Taylor Swift Recording

Right after Kim Kardashian West dropped receipts to prove Taylor Swift knew Kanye West would throw in a line about her in his “Famous” track, news broke that Taylor’s lawyer fired off a threatening letter to Yeezy months ago telling him action will be taken if he releases any audio of his and Taylor's conversation.

Well, it doesn’t look like it’ll hold water in court, thanks to a loophole in the law.

According to TMZ, the Wests won’t face criminal prosecution for the recording because she had no expectation of privacy since she knew she was on speakerphone.

Here’s how it all breaks down:

In California, if someone records a "confidential communication" and the other party to the conversation doesn't know it's being taped, it's a crime. But "confidential communication" does not include conversations that "may be overheard."

Since Taylor was on speakerphone during the call and producer Rick Rubin chimed in on the conversation a few times, Taylor knew she “may be overheard.” Not only that, crew members who were in the studio were also heard talking in the background in the full clip. 

Unfortunately for Taylor, she can’t prosecute for invasion of privacy. Well she could, because sometimes dragging someone through court just because is a tactic is revenge in itself, but she may not win.
